Terms of Service

Effective date: October 14, 2026
Company: GVS Digital LLC d/b/a SwiftlyBook ("SwiftlyBook," "we," "us")
Contact: support@swiftlybook.com

These Terms govern your use of SwiftlyBook. By signing up or using the service, you ("Customer," "you") agree to them. If you're accepting on behalf of a business, you confirm you have authority to do so.

1. The service

SwiftlyBook follows up with your new leads by text message, offers them times based on your calendar availability, books calls and appointments, sends reminders to you and your leads, and alerts you when a lead needs a personal call. Features may change over time as we improve the product.

2. Your account

3. Plans, billing, and cancellation

4. Your responsibilities for messaging (important)

SwiftlyBook sends texts on your behalf, under your business name. You are the sender, and you are responsible for following the laws and carrier rules that apply to your messages, including the Telephone Consumer Protection Act (TCPA), state telemarketing and texting laws, CAN-SPAM, and CTIA and carrier guidelines.

You agree that:

We may suspend messaging if we believe your use violates these rules or puts our carrier relationships at risk.

5. Automated features

SwiftlyBook uses automated tools to understand lead replies (for example, which time a lead is asking for). These tools only interpret messages; the times offered and the wording sent come from your calendar and your settings. Automated tools can still misunderstand. When it isn't sure, SwiftlyBook hands the conversation to you instead of guessing. You remain responsible for your customer relationships and for reviewing conversations when alerted.

6. Third-party services

SwiftlyBook relies on third-party providers, including hosting and messaging providers, phone carriers, calendar providers such as Google Calendar, and our payment processor (Stripe). Their availability and terms are outside our control. Message delivery depends on carriers and isn't guaranteed.

7. Results

SwiftlyBook is designed to help you respond faster and book more conversations, but we don't guarantee any specific number of leads, bookings, sales, or revenue. The only guarantee we offer is the 30-day money-back guarantee in Section 3.

8. Your data

9. Our property

SwiftlyBook's software, workflows, message logic, branding, and content belong to us or our licensors. You may not copy, resell, reverse engineer, or create competing products from them.

10. Suspension and termination

We may suspend or end your access if you break these Terms, don't pay, or create legal or security risk. You may stop using the service at any time.

11. Disclaimers

The service is provided "as is" and "as available." To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of liability

To the extent the law allows, SwiftlyBook won't be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost business. Our total liability for any claim is limited to the amount you paid us in the 3 months before the claim arose.

13. Indemnity

You'll defend and indemnify SwiftlyBook against claims, fines, and costs arising from your messages, your contact lists, your lack of consent from message recipients, or your breach of these Terms.

14. Governing law

These Terms are governed by the laws of the State of Maryland, without regard to conflict-of-law rules. Disputes will be handled in the state or federal courts located in Prince George's County, Maryland.

15. Changes to these Terms

We may update these Terms. If the changes are significant, we'll notify you by email or in the app at least 15 days before they take effect. Continuing to use the service after that means you accept the changes.
